Visas for nurses, physical therapists and other healthcare workers

A common way to acquire lawful permanent resident status in the US is through your employment. This method has become especially common in recent years for health-care workers due to the severe shortages that currently exist in the US health-care industry. Nurses, Physical Therapists and other individuals trained in the health-care field have been able to capitalize on the lack of qualified workers already in the US by more quickly obtaining lawful permanent resident status (“green card”).

However, despite the large number of people attempting to obtain permanent resident status as health-care workers, it remains a complex area of US immigration law. It is a common misconception that merely possessing a Bachelor’s or Master’s Degree from a foreign institution will lead directly to a green card. On the contrary, there are many procedural steps that must be closely followed to successfully immigrate to the US as a health-care worker.

File those H-1Bs now

The immigration community is preparing itself for the exhaustion of the H-1B cap. The United States Citizenship and Immigration Services’ (USCIS) most recent count shows that as of April 13, 2012 approximately 20,600 H-1B cap-subject petitions were received out of the 65,000 available visa numbers. Of the 20,000 separate allotment of H-1B visas for workers with advanced degrees, 9,700 have already been accepted. Each week larger numbers of H-1B petitions are being filed with USCIS. At this rate, many expect H-1B visa numbers will be exhausted by the end of May.

While this is a promising signal that the economy is heating up, employers and H-1B workers will have to scramble for the last remaining visa numbers until Congress acts to increase the quota. Since the quota is expected to be reached fairly soon, H-1B petition preparations should be their final stages. Those people looking for petitioners should intensify their job search right now to ensure sufficient time for an H-1B petition to be prepared for filing before the end of the year.

Nurses and Physical Therapists Have a Second Chance to Immigrate.

Approximately six years ago, immigrant visa numbers for skilled workers began retrogressing. The skilled worker group includes registered nurses (RNs) and physical therapists (PTs). In 2006, employers petitioned RNs and PTs to fill those positions for which there is an acute shortage. These petitions, combined with those for other skilled workers, created a huge demand for visa numbers resulting in the current six-year backlog.

The Circuit accepts CSPA class action for en banc review!

We are ending April and beginning May on a very positive note in our ongoing-efforts to reunite families. On Friday, April 20, 2012, the 9th Circuit Court of Appeals ordered that the Costelo Class-Action lawsuit filed by Reeves & Associates and its consolidated case De Osorio be reheard en banc. En banc literally means “full court”. However, in point of fact, the number of judges who will rehear the case is 11. They are not bound by the decision previously issued in this case. As of today, the decision issued by the three-judge panel is vacated and has no legal effect. The en banc court will rehear whether CSPA section 203(h)(3) means that all family-based derivative beneficiaries are eligible to retain their parent’s original priority date.

Green cards at US embassy with pre-approved waivers

The Obama administration has started the process of obtaining an over stay waiver in the United States by enacting new Federal Regulations for aliens who are immediate family members of American citizens who do not qualify for a green card in the US Under these proposed regulations, an estimated one million individuals will be eligible to benefit from significant changes in the processing of unlawful presence waivers at US Embassy’s outside the United States.
