CALLER: Good morning... I have a questions and also requesting advise how to proceed regarding issues on my house.

1) Oct 2008 I had a loan modification with a Law office. unfortunately, I had not given an update on my case, I had already paid the $2500.00 in full.

2) Beginning of January. I had sent them a letter stating that I would withdraw my loan modification with their office as they had not done anything during those period. I switch to another company which has filed my application already  initially I paid them $500.00

3) I received a notice of trust deed sale from my mortgage yesterday.  I faxed the paperwork to the company that does my loan modification now. What can I do or what can the company can do for me to prevent the sale of my house. I am really distressed and would need help from a trustworthy person. though the second company had assured me that they will help to avoid the foreclosure.

4) Shall I send money to my lender at least if not all half of whatever money I can have even I am waiting for my loan modification? Really desperate to know some enlightening advise.

Ken Go: First of all, I will request you to talk to the lawyer since you are paying the law firm, I think you deserve his or her time. Then if you are not going to get a reply or a approval soon, you ask for your money back from the firm for their non-performance. I suggest you call your lender yourself and ask if they will take a partial payment or however much money you can give them. Remember, once you have a "NOD" (Notice of Default) lenders will only want the full amount owed with penalties. With regards to your second "Loan Modification" firm, make sure you don’t give them any more money that should be going to the lender.
