As a long time Immigration Lawyer, I’m still amazed at the level of misinformation and misperceptions about immigration matters within the immigrant community. I’m often confronted with individuals who have been given incorrect information or even worse have filed for something that they do not qualify for. Often they have been given this “advice” from non-attorneys or other unqualified individuals. Others have been given anecdotal stories such as “my brother did it” or “my cousin was in the same situation” or been promised results that simply could not be met.
The fact is that each case is different despite certain similarities. Immigration laws are very complex and always changing. It is so complex that it is one of only a half dozen areas of practice that an attorney may be recognized as a specialist by the State Bar of California.
The complexities of U.S. Immigration Laws may not be apparent to an individual who has not had the appropriate legal training or who is not practicing in this area of the law. For example, often a date of a conviction could mean the difference between deportation and relief. Immigration Laws change all the time and many factors need to be considered before applying for relief.
Similarly, there are numerous published cases that effect immigration laws. The Courts are charged with interpreting immigration statutes which are often vague or contradictory. For example, not too long ago one Court overturned an earlier decision of another Court regarding the immigration consequences of a DUI conviction as it relates to deportability. More, recently the Courts held that commercial burglary many not be a deportable offense under certain circumstances. There are numerous examples of such changes in Immigration Law especially after the 1996 changes under IIRAIRA.
