Panatag (Scarborough) Shoal is within PH Exclusive Economic Zone

ARTICLE 1 on National Territory of the 1987 Philippine Constitution includes “all other territories over which the Philippines has sovereignty or jurisdiction…including its territorial sea, the sea-bed, the subsoil, the insular shelves and other submarine areas”.

Moreover, the second sentence of the definition of Philippine National Territory further includes its archipelagic waters: “The waters around, between, and connecting the islands of the archipelago, regardless of their breath and dimensions, form part of the internal waters of the Philippines.”

CA Board of Registered Nursing withdraws citation order and fine against Filipino RN

BY INFORMAL Citation Conference Decision dated April 10, 2012, the California Board of Registered Nursing withdrew its Citation Order and Fine dated February 14, 2012, against a Filipino registered nurse working in Torrance, California.

The Citation Order and Fine for $1,000.00 dated February 14, 2012, contained two causes for citation: (a) the First Cause for Citation on the Conviction of the Filipino registered nurse (a surgeon in the Philippines) on march 16, 2011, by nolo contendere of petty theft (Penal Code Section 484 (a)), and of disturbance of the peace (Penal Code Section 415 (a), an infraction; and (b) the Second Cause of Citation on his “No answer to the question whether he was convicted of any crime, in his renewal application of his RN license.

LA immigration court dismisses removal proceedings of Filipino lawful permanent resident

BY DECISION and Order dated February 17, 2012 (received by mail on February 27, 2012), Los Angeles Immigration Judge Monica M. Little terminated the removal proceedings of a Filipino lawful permanent resident, alleged to have been convicted of two crimes involving moral turpitude not arising out of a single scheme of criminal misconduct.

Indeed, Section 237(a)(2)(A)(ii) of the Immigration and Nationality Act (INA) charges an alien with removal from the United States, if, at any time after admission, he or she has “been convicted of two crimes involving moral turpitude not arising out of a single scheme of criminal misconduct.”

Accountant convicted of felony grand theft granted US naturalization

ON November 7, 2011, ISO Kevin Prealow of the USCIS Los Angeles Field Office granted the Form N-400, Application For Naturalization, filed on July 27, 2011, of a Filipino accountant convicted of a felony grand theft committed in 1994.

This author represented the Filipino client, whose name is withheld to protect his privacy and maintain confidentiality, and personally appeared at the November 7, 2011 interview with him. His two prior applications for naturalization were denied.

2011 $20 billion remittances: Boon or Bain?

Eric Manlunas, Managing Partner of Siemer Ventures, the Moderator of the Fireside Chat with FilAm Thought Leaders held by the Philippine Development Foundation (PhilDev) on March 1, 2012, at the Shade Hotel in Manhattan Beach, asked the panel, consisting of Winston Damarillo, Dado Banatao, Antonio Alvarez II, and UCLA’s Melanie De La Cruz-Viesca, to discuss the mixed blessings of the $20 billion remittances of overseas Filipinos to the Philippines.

Earlier, Antonio “Tony” Alvarez II, Co-Chief Executive of turnaround firm Alvarez & Marsal LLC, referred to overseas Filipinos as heroes, although a dissent was voiced that they do not consider themselves as heroes, rather as outcasts forced to be separated from their families for failure of the Philippine economy to provide jobs at home.
